Is the owner automatically responsible for a dog bite in Illinois?

Illinois follows a strict-liability rule under the Animal Control Act. If a dog injures a person who was peaceably conducting themselves in a place they were lawfully allowed to be, and did not provoke the animal, the owner is generally liable, even for a first bite.

What if the dog never bit anyone before?

Illinois does not require proof that the dog was previously dangerous. Unlike some states with a 'one bite' rule, the owner can be liable even for a first-time attack.

Who actually pays the compensation?

In most cases the owner's homeowner or renter insurance covers dog bite claims. That means you can be fully compensated without the owner, often a friend, neighbor, or family member, paying out of pocket.

My child was bitten. What should we do?

Seek medical care immediately, photograph the injuries, identify the dog and owner, and report the bite to animal control. Then call us. Claims involving minors have special rules, and we handle them with care.
